Welcome to Up Your Club, operated by 1314 Media, Bosmanstraat 5, 5591 MD Heeze, The Netherlands.
By creating an account or using the platform, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must stop using the platform.
1. Scope of the Service
Up Your Club provides a digital golf analytics platform that allows users to upload CSV shot data, analyze performance, view insights, and receive training-related guidance.
- The website is publicly accessible
- Dashboard and analytics features require a registered account
- Free and paid subscription plans are available with different limits
The platform provides analytical and training-related information only and does not replace professional coaching, medical advice, or supervised physical training. Users remain fully responsible for how they apply insights and recommendations.
The Service is not intended for use in jurisdictions where such use would be unlawful. Users access the platform at their own initiative and are responsible for complying with applicable local laws.
2. Training Advice and Injury Disclaimer
The platform may display training tips, performance guidance, or practice recommendations for informational purposes only.
- Up Your Club does not provide medical, physiotherapy, or professional sports training services
- Training recommendations may not be suitable for every user
- Users are solely responsible for determining whether activities are safe
Certain features of the platform may use artificial intelligence systems to generate training suggestions, performance analysis, or other insights. AI-generated outputs are informational estimates only and may contain inaccuracies or incomplete information.
AI-generated content does not constitute professional coaching, medical advice, or certified training guidance. Users should not rely solely on AI-generated outputs when making training decisions and remain responsible for evaluating whether suggested activities or techniques are appropriate and safe.
Sports and physical training involve inherent risks. By following guidance provided on the platform, users acknowledge they do so at their own risk.
To the fullest extent permitted under Dutch law, Up Your Club and 1314 Media are not liable for injuries, health issues, or physical damages arising from training activities or changes in technique.
3. Eligibility
- You must be at least sixteen (16) years old
- You must be legally capable of entering into a contract
- Accounts for minors are not permitted
4. Account Responsibility
A registered account is required to access platform features.
- You are responsible for keeping your login credentials secure
- You are responsible for all activity under your account
- You must notify us if unauthorized access is suspected
We reserve the right to suspend or restrict accounts in cases of misuse, abuse, fraud, excessive system load, or security risks.
5. Subscriptions, Payments, and Billing
Payments are processed securely through Paddle.com, which acts as the Merchant of Record for all transactions on the platform. Paddle is responsible for processing payments, collecting applicable taxes (such as VAT), issuing invoices, and managing refunds where applicable.
Up Your Club and 1314 Media do not store payment card details.
New paid subscriptions include a seven (7) day free trial period. During the trial period, no charges are made.
If the subscription is not canceled before the trial ends, the subscription automatically converts to a paid plan and the applicable subscription fee will be charged by Paddle.
Subscriptions renew automatically at the end of each billing period unless canceled before the renewal date.
Users must manage and cancel their subscriptions through their account settings or via Paddle’s customer billing portal.
Once a paid billing period has started, payments are non-refundable unless required by applicable law or processed at Paddle’s discretion in accordance with their refund policies.
We reserve the right to modify pricing, subscription plans, or trial availability with reasonable notice.
6. EU Consumer Withdrawal Rights
Under EU consumer protection laws, consumers generally have a fourteen (14) day right of withdrawal for online purchases.
Up Your Club provides a seven (7) day free trial allowing users to evaluate the service before any payment is made.
Once the trial period ends and the subscription converts to a paid service, users explicitly consent to the immediate delivery of a digital service.
By starting the paid subscription after the trial period, the user acknowledges that the right of withdrawal is waived once the digital service has begun.
7. Data Ownership, Processing, and Privacy
Users retain ownership of all golf performance data they upload.
By using the platform, users grant Up Your Club a limited, non-exclusive license to process uploaded data solely to:
- Operate the platform
- Generate analytics and visualizations
- Maintain and improve services
- Provide technical support and troubleshooting
Personal data is processed in accordance with our Privacy Policy, the General Data Protection Regulation (GDPR), and applicable privacy laws.
We do not sell user data and do not use uploaded performance data for marketing, profiling, or automated decision-making.
8. CSV Uploads, Data Accuracy, and Analytics Disclaimer
- Users are responsible for the accuracy and legality of uploaded CSV files
- Up Your Club does not guarantee the accuracy of analytics or predictions
- Up Your Club is not responsible for errors caused by incorrect or incomplete data
- Up Your Club does not guarantee performance improvement
- Up Your Club is not liable for decisions made based on analytics outputs
All analytics and insights are estimations only.
9. Third-Party Data Sources
The platform may rely on data generated by third-party launch monitors, simulation software, or external devices.
Up Your Club does not control these third-party providers and does not guarantee compatibility, availability, or accuracy of imported data if external providers modify or discontinue their data formats, export functions, or software.
Users acknowledge that changes made by third-party providers may affect the availability or functionality of data imports and analytics features.
10. Use of User Data for Support and Debugging
Authorized staff may access user-uploaded data only when required to resolve technical issues.
- Access is limited to essential troubleshooting
- Used only for debugging, maintenance, and service continuity
- Not retained longer than necessary
- Never used for secondary purposes
11. Data Retention and Deletion
- Free account data is retained while the account remains active
- Subscription and billing data is retained per legal obligations
- User-uploaded data is retained until deleted or account termination
- Support communications are retained for a reasonable period
- Analytics data follows provider retention settings
Users may request data export or deletion via account settings or by contacting support.
12. Intellectual Property and Platform Protection
All intellectual property, including software, analytics logic, UI design, workflows, branding, database structures, and proprietary algorithms, belongs exclusively to 1314 Media.
- Users may not copy, scrape, or reverse-engineer the platform
- Users may not replicate platform functionality
- Users may not use platform insights to build competing products
- Users may not harvest data using automated tools
- Users may not circumvent platform protections or system limits
13. Acceptable Use
- Users must not use the platform unlawfully
- Users must not upload malicious or infringing content
- Users must not disrupt platform security or stability
- Users must not exploit the platform commercially without authorization
14. Service Availability and Backups
The platform is provided on an “as available” basis.
Up Your Club does not guarantee uninterrupted or error-free service. Users are responsible for maintaining their own backups of important data.
15. Limitation of Liability
To the maximum extent permitted under Dutch law, Up Your Club is not liable for indirect or consequential damages, lost profits, data loss, or training and performance outcomes.
Total liability is limited to the amount paid by the user in the one (1) month preceding a claim.
16. Indemnification
You agree to indemnify and hold harmless 1314 Media from claims, damages, or losses arising from misuse of the platform or violations of these Terms.
17. Force Majeure
Up Your Club is not liable for service failures caused by events beyond reasonable control, including hosting outages, cyber incidents, natural disasters, government actions, or infrastructure failures.
18. Account Suspension and Termination
Users may close their account at any time.
Up Your Club may suspend or terminate accounts for violations, abuse, fraud, non-payment, or legal and security risks. Upon termination, access to platform data may be removed.
19. Electronic Communications
By creating an account or using the Service, you consent to receive communications electronically, including agreements, notices, disclosures, and other communications via email or through the platform.
20. Governing Law and Jurisdiction
These Terms are governed by Dutch law.
All disputes fall under the exclusive jurisdiction of the courts of The Netherlands.
21. Entire Agreement and Severability
These Terms constitute the entire agreement between you and 1314 Media regarding the Service and supersede any prior agreements or understandings.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
